West Bengal Chief Minister Mamata Banerjee's nephew and Trinamool Congress MP Abhishek Banerjee is facing fresh legal troubles.
After the Trinamool Congress (TMC) suffered a setback in the Assembly elections, Mamata Banerjee and her nephew Abhishek Banerjee have come under increasing political and legal pressure.
Amid this, Abhishek Banerjee could face arrest in connection with a six-year-old defamation case, as the Madhya Pradesh Police may now proceed with action against him.
The court has cleared the way for such action. The court's order came on the same day two new cases were filed against the MP in West Bengal.
Abhishek Banerjee, who is facing inquiries in multiple cases by various investigative agencies, is now confronting another legal challenge.
A single bench of Justice Pramod Kumar Agarwal dismissed Banerjee's petition and vacated the stay granted by the High Court on November 12, 2025.
The court said:
No one appeared on behalf of the petitioner even in the first phase. It appears that the petitioner has no interest in the proceedings of this petition. The stay granted in favor of the petitioner is also being vacated.
Now, the Jabalpur bench of the Madhya Pradesh High Court has lifted the stay on the arrest warrant issued against Abhishek Banerjee. This clears the way for Banerjee's arrest.
It is believed that the Madhya Pradesh Police may soon travel to West Bengal to arrest him. It is also possible that he may seek relief in the Supreme Court before the MP Police take action.
Six-year-old defamation case
Lifting the stay on the arrest warrant issued against MP Abhishek Banerjee, the court directed that a copy of the order be immediately sent to the trial court. The case dates back six years, to the alleged use of a "gunda" remark by Abhishek Banerjee during an election rally in November 2020. Vijayvargiya had approached the MP-MLA court.
Abhishek Banerjee had approached the High Court after the Special MP-MLA Court issued an arrest warrant against him. The petition stated that he was currently a Member of Parliament and therefore unlikely to abscond. Meanwhile, two FIRs have been filed against him in the South 24 Parganas district of West Bengal based on a complaint by BJP leader Abhijit Das.
