Nine police officers have been issued non-bailable warrants by a court in Muzaffarpur, Bihar, for allegedly failing to testify as prosecution witnesses in a 2018 case in which six individuals were charged with assembling with weapons to plan a robbery in the area.
On September 10, Additional District and Sessions Judge-11 Dr. Kishor Kunal issued an order requiring the prosecution to present the witnesses and directed the Muzaffarpur Senior Superintendent of Police and the Saraiya station house officer to ensure their appearance in court.
Court takes action over repeated absence
The order states that the case was still pending at the prosecution evidence stage. The prosecution witnesses were issued summonses on May 8, 2025, and bailable warrants on August 20, according to the court. The court ordered its office to issue non-bailable warrants against the witnesses as they had failed to appear.
Sub-Inspectors Md Allauddin, Sattrudhan Sharma and Yogendra Kumar Singh; BMP havildar Sanjay Sharma; constables Abhay Kumar Singh, Azhar Khan and Rahul Kumar; driver Radhakant Prasad; and investigating officer Anil Kumar are among the witnesses listed in the order. According to the order, they are all connected to the Saraiya police station in Muzaffarpur district.
In order to produce the witnesses, the court ordered that copies of the order be delivered to the Muzaffarpur SSP and the Saraiya SHO. Additionally, it instructed the prosecution to present the witnesses “as per his priority.”
Police raid follows tip-off about armed suspects
The case in question was filed after a police raid at the Bhagat Singh High School ground in Manikpur late on September 17, 2018. Around 9:30 p.m., Saraiya police station SHO Md Allauddin received information that seven or eight criminals, allegedly armed with weapons, had assembled there to organise a crime, according to the prosecution's case documented in previous bail decisions.
An armed police team arrived at the location. Three individuals on two motorcycles were able to escape after spotting the police, according to the prosecution's case, while other men allegedly tried to leave but were caught.
A loaded country-made pistol and a live cartridge were allegedly recovered from one of the accused during searches carried out in the presence of independent witnesses, according to the information recorded by the court during the previous bail proceedings. Two other suspects were also found with loaded handguns and live ammunition.
