A suo motu case has been filed against former West Bengal Chief Minister Mamata Banerjee in view of her alleged violation of orders from the Calcutta High Court regarding a rally organized by the Trinamool Congress Chhatra Parishad (TMCP) on Friday. The rally, which was organized in order to celebrate TMCP's foundation day, was sanctioned by the high court on August 28; however, certain conditions had been set by the court. It is said that these conditions were not met.
Conditions of High Court Said to Be Overlooked
According to the Calcutta High Court, the rally was allowed on the condition that one flank of the road would be kept open at all times during the course of the rally to ensure that the traffic flow is uninterrupted. According to the police authorities, this particular instruction was overlooked, and the entire stretch of the road was occupied during the process of the celebration. It should also be noted that the rally continued for more time than the one allotted by the court.
Sections That Have Been Referenced In The FIR
This case has been registered at Hastings Police Station, and the referenced sections include Sections 61(2), 223, 125(a), 132 and 285 of the Bharatiya Nyaya Sanhita. These sections mainly pertain to offenses like defiance of orders by any authority and action under unlawful assembly. So far, the police have not clarified how they intend to proceed further in their probe and whether Banerjee would be asked to come for questioning. This case is bound to invite political interest in the coming days.
